These Terms of Use & Sale form a binding agreement between you and Jar Hearts when you use jarhearts.com, create an account or submit an order for delivery in the United States.
By selecting the checkout control that confirms your order, you acknowledge these terms and the policies incorporated below. If you do not agree, do not submit the order. Mandatory consumer rights remain unaffected.
1. Parties, scope and incorporated policies
“Jar Hearts,” “we,” “us” and “our” refer to the operator and seller using the Jar Hearts business name at Jar Hearts, 5301 Polk Street, Building 13, Houston, Texas 77023, United States. “You” means the person accessing the site or purchasing goods. “Site” means jarhearts.com and its checkout, account and customer-service functions. “Product” means merchandise offered for direct purchase from Jar Hearts.
These terms incorporate the Shipping & Delivery Policy, Returns & Refunds Policy, Warranty & Product Support Policy, Privacy Notice, Cookie Policy and any product-specific conditions shown before purchase. The policies apply only to direct Jar Hearts orders placed on this site for delivery to a supported U.S. address and paid in U.S. dollars.
2. Eligibility and authority
You must be at least 18 years old and legally capable of entering a contract. If you order for a company or other organization, you represent that you are authorized to bind it. The store is intended for lawful U.S. purchases. We may decline orders that cannot lawfully be sold, shipped or delivered to the stated destination.
3. Accounts and information you provide
You may check out as a guest when that option is available or use an account. Information supplied for an account or order must be current, complete and accurate. You are responsible for safeguarding credentials and for activity performed through your account, except to the extent caused by our failure to use reasonable safeguards. Notify us promptly of suspected unauthorized access. We may suspend an account where reasonably necessary to investigate fraud, abuse, security threats or material breach of these terms.
4. Electronic records and communications
You consent to receive order acknowledgments, shipment notices, invoices, policy notices and other transactional communications electronically at the email address or account you provide. You may retain these communications by printing or saving them. Marketing messages, if offered, are separate from necessary transactional communications and include the legally required method to unsubscribe. Contact us if you need an accessible or paper copy of a transaction record.
5. Product information, condition and compatibility
We use manufacturer, distributor and catalog data to present product titles, images, specifications, dimensions, compatibility, model identifiers, condition, stock and warranty information. We take reasonable steps to correct material errors, but displays, packaging and manufacturer revisions may differ. Images may show accessories not included; the written “included” description controls. Product measurements and colors may vary within ordinary tolerances.
You are responsible for reviewing model numbers, interfaces, voltage, region, operating-system, network, mounting, size and other compatibility requirements before purchase. Contact support before ordering if compatibility is uncertain. A product described as refurbished, renewed, open-box, used or otherwise non-new is sold in that disclosed condition; if no such designation appears, the listing is represented as new. We do not substitute a materially different product without your consent.
6. Prices, promotions, taxes and errors
Prices are stated in U.S. dollars. Applicable shipping charges, discounts and taxes are displayed before the order is submitted. A promotion may have its own eligibility, duration, quantity and combination rules. Reference or strike-through prices are intended to reflect a bona fide comparison disclosed on the offer and are not a guarantee of market price.
If a material pricing, description or availability error is discovered before acceptance, we may correct it and ask whether you wish to proceed, or cancel the affected item and promptly release the authorization or refund the amount paid. We will not charge a higher corrected price without your affirmative agreement. Price changes do not affect an order already accepted, except as required by law.
7. Order submission, acknowledgment and acceptance
A product listing is an invitation to submit an order, not a promise to sell. Your order is an offer to purchase the listed products on these terms. An automated receipt confirms that we received the order; it does not constitute acceptance. Unless we expressly say otherwise, acceptance occurs when we send a shipment confirmation for the applicable product. Separate shipments may be accepted separately.
Before acceptance, we may reject or cancel an order for objective reasons including unavailable inventory, failed payment authorization, inability to verify identity or address, suspected fraud, quantity or resale abuse, legal or carrier restrictions, or an obvious material error. If payment was captured for a cancelled item, we will initiate a refund to the original payment method. We may limit quantities reasonably necessary to protect inventory availability or prevent abuse.
8. Payment authorization and Stripe
Stripe processes payment credentials and payment transactions on our behalf. By submitting an order, you authorize Jar Hearts and Stripe to obtain an authorization and charge the final amount shown at checkout, including product price, shipping and applicable tax. An authorization hold may reduce available credit before capture and may remain until the issuing bank releases it.
You represent that you are authorized to use the selected payment method. We may use Stripe and other service providers to verify the transaction, prevent fraud and comply with law. Do not send full card numbers or security codes to customer support. Refunds are issued to the original payment method unless law requires or you expressly agree to another method. Stripe’s handling of payment information is also described in its Privacy Policy.
9. Fraud review, security and cancellation
We may request reasonable information to verify a billing identity, shipping address or transaction. Failure to complete a reasonable verification may result in cancellation. We do not guarantee that a cancellation or address-change request can be completed after fulfillment begins. If an accepted order cannot be stopped, the return process applies. Nothing here limits rights regarding an unauthorized electronic-fund or credit-card transaction.
10. Fulfillment, delivery, title and risk
We ship only to supported United States destinations. Available services, charges and estimated shipment or delivery dates appear at checkout or in the order confirmation. Those transaction-specific estimates form part of the order, subject to the Shipping & Delivery Policy. If we cannot ship within the stated time—or, if no time is stated, within the period required by the FTC Mail, Internet, or Telephone Order Merchandise Rule—we will provide the legally required delay option, revised date, cancellation right or refund.
Unless applicable law requires otherwise, title and risk of loss pass to you when the product is delivered to the shipping address you provided. We remain responsible for selecting and tendering goods to the carrier and for legally required remedies for loss or damage before delivery. Signature requirements, carrier limitations and special handling for batteries or oversized goods may apply.
11. Returns, refunds and exchanges
Our voluntary 30-day return program and the procedures for damaged, defective or incorrect items are stated in the Returns & Refunds Policy. It explains authorization, condition, data removal, serial-number verification, return shipping, exclusions, inspection and refund timing. The policy is incorporated here. No procedure or exclusion limits a non-waivable remedy under applicable law.
12. Warranties, defects and support
Any written manufacturer warranty identified for a product is provided under that manufacturer’s terms and is made available as described in the Warranty & Product Support Policy. Unless a separate Jar Hearts written warranty is expressly shown on the product page, Jar Hearts does not create an additional written product warranty. We will not disclaim or limit an implied warranty or statutory remedy where doing so is prohibited.
Product statements that are specifically made part of the bargain remain subject to applicable express-warranty law. General recommendations, buying guides and editorial content are informational and are not a substitute for the manufacturer’s instructions, safety warnings or professional installation where required.
13. Product safety and recalls
Follow all manufacturer instructions, warnings, electrical ratings, battery requirements and installation limits. Stop using a product that is recalled, overheats, swells, sparks, emits smoke or presents another apparent hazard. Our Product Safety & Recalls page explains reporting and recall resources. These terms do not waive any recall, injury, product-liability or safety right that cannot lawfully be waived.
14. Reviews, questions and user content
If the site permits reviews, questions, images or other submissions, you retain ownership of your content and grant Jar Hearts a nonexclusive, worldwide, royalty-free license to host, reproduce, format and display it for operating and promoting the store. The license ends when the content is deleted from active systems, subject to reasonable backup retention and prior lawful uses. You represent that your submission is truthful, based on genuine experience where it describes one, and does not violate another person’s rights.
We may moderate content that is unlawful, fraudulent, threatening, obscene, discriminatory, privacy-invasive, infringing, spam, unrelated to the product, contains malware or exposes confidential information. We do not prohibit or penalize an honest review merely because it is negative. Any incentive for a review must be disclosed and may not be conditioned on positive sentiment.
15. Site license and intellectual property
Jar Hearts grants you a limited, revocable, nonexclusive and nontransferable license to use the site for personal or internal business shopping in accordance with these terms. The Jar Hearts name, site design, original text, graphics, organization and software are protected by intellectual-property laws. Product names and third-party marks belong to their respective owners. You may not copy, sell, frame, republish, reverse engineer or exploit protected site material except with permission or where law expressly allows.
16. Prohibited conduct
You may not use the site to violate law; infringe rights; submit false order or payment information; evade quantity or access controls; introduce malicious code; interfere with security or availability; scrape or query the site at a disruptive scale; impersonate another person; or purchase controlled or restricted products for an unlawful destination or end use. Reasonable, non-disruptive use of publicly available information by consumers, search engines and accessibility tools is not prohibited.
17. Third-party technology and links
The site relies on third-party technology providers for hosting, analytics, payment processing, communications, fraud prevention and delivery. Links to manufacturer documentation or other informational websites are provided for convenience. We do not control third-party sites and are not responsible for their independent content or privacy practices. This section does not reduce Jar Hearts’ obligations as seller for an order placed through our checkout.
18. Disclaimer of site-related warranties
To the fullest extent permitted by law, the site and general editorial content are provided “as available” without a warranty that access will be uninterrupted, error-free or compatible with every device. This site-related disclaimer does not eliminate any express product promise, manufacturer warranty, implied warranty that cannot lawfully be disclaimed, or statutory consumer right.
19. Limitation of liability
To the fullest extent permitted by law, Jar Hearts will not be liable for indirect, incidental, special, exemplary or consequential damages, or loss of profits, revenue, data or business opportunity, arising solely from site use or breach of these terms when such damages were not reasonably foreseeable. For a claim concerning an order, our aggregate contractual liability will not exceed the amount paid for the affected product.
The limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, violation of privacy or data-security duties where limitation is prohibited, product-liability obligations that cannot be waived, or any remedy that applicable law makes non-waivable. Some states do not permit certain exclusions, so the exclusions apply only to the lawful extent.
20. Indemnification for misuse
To the extent permitted by law, you agree to indemnify Jar Hearts against third-party claims, damages and reasonable costs arising from your unlawful commercial misuse of the site, your material breach of Sections 14–16, or content you submit that infringes another person’s rights. This obligation does not apply to ordinary consumer use, a claim caused by Jar Hearts, or any liability that cannot lawfully be shifted.
21. Events beyond reasonable control
Neither party is liable for delay caused by events beyond its reasonable control, including severe weather, disaster, labor disruption, carrier or utility outage, cyberattack, governmental action, epidemic or supply interruption, provided the affected party uses reasonable efforts to mitigate. This clause does not excuse payment already due or override the FTC-required delay, cancellation and refund rights described in the Shipping Policy.
22. Governing law and dispute forum
Texas law governs these terms and direct Jar Hearts orders, without regard to conflict-of-law rules and subject to the Federal Arbitration Act only if a separate valid arbitration agreement is later expressly accepted. No arbitration or class-action waiver is created by these terms. State and federal courts of competent jurisdiction located in Harris County, Texas will be the nonexclusive forum, except that a consumer may bring a claim in any forum available under mandatory law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before filing a dispute, we encourage you to contact info@jarhearts.com with the order number and requested resolution. This informal step is optional and does not shorten or waive a limitation period or right to seek relief.
23. General contract provisions
These terms and incorporated policies are the entire agreement regarding site use and the order, except for transaction-specific information and an express written warranty. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder continues. A waiver must be express and applies only to the stated instance. Headings are for convenience. Provisions that by nature should survive—including payment, ownership, warranty limitations, liability, dispute and record provisions—survive termination.
You may not assign an order or these terms in a way that materially prejudices us without consent. We may assign them in connection with a merger, reorganization or sale of substantially all relevant assets, provided consumer rights are not reduced. No person other than the parties has a contractual right under these terms.
24. Changes and contact
We may revise these terms prospectively for legal, operational or service changes. The version presented when you submit an order governs that order unless you affirmatively agree to a later modification. Material changes to ongoing account use will be announced through the site or another reasonable channel.
